A DUI (Driving Under the Influence) is a serious charge in Arizona. A charge of DUI includes driving under the influence of alcohol, drugs or any combination of the two. The penalties for a DUI are outlined in the Arizona Revised Code (A.R.S.). The consequences for a DUI are dependant upon a number of conditions, including prior offenses and the degree of intoxication. A conviction for DUI results in both direct and indirect consequences. The direct punishment includes fines, jail time and mandatory installation of an ignition interlock devise. Installation of an ignition interlock devise is mandatory, even for a first time offense. The indirect consequences include increased auto insurance rate and travel restrictions to some countries, such as Canada.
DUI First Offense
A.R.S. section 28-1381 sets forth the punishments for driving while impaired to the slightest degree by drugs or alcohol. This section applies to those convicted of driving with the metabolite of an illegal drug in their system or blood alcohol content (BAC) of .08 to .149 within a two hour period of operating a motor vehicle. A conviction results in jail time between one day and six months and a fine ranging between $250 and $2,500. The Motor Vehicle Division (MVD) will suspend your driver’s license for 90-days and add eight points to your record. Additionally, you will be required to install an ignition interlock devise on any vehicle you operate. You cannot drive any vehicle that is not equipped with an ignition interlock devise. A.R.S. 28-1461 requires that an ignition interlock devise installation for a period of at least one year.
Arizona Extreme DUI First Offense
Driving with a BAC between .15 and .199 is a class 1 misdemeanor under the provisions of A.R.S. 28-1382 (A) (1). A conviction is punishable by between 30 days and six months in jail and a fine ranging between $250 and 2,500. Additionally, MVD will add 8 points to your record and suspend your driver’s license for 90-days. You must also install an ignition interlock devise for at least one year.
Arizona Super Extreme DUI First Offense
Driving with blood alcohol content over .2 is considered a Super Extreme DUI in Arizona. A conviction for Super Extreme DUI is punishable by a minimum jail term of 45 days to six months, even for a first offense. Additionally, fines ranging from $450 to $2,500. Your driver’s license will be suspended for at least 90 days. MVD will add 8 points to your record and require the mandatory installation of an ignition interlock devise.
